Welcome to the Groove Fitness LLC, Grooving with Gigi website. Groove Fitness LLC provides its services to you subject to the following Terms and Conditions. If you visit, use a service, or make purchases, you agree to abide by these Terms and Conditions when you use the Site. If you do not agree to these Terms and Conditions of Usage, do not use any portion of the Site. Groove Fitness LLC reserves the right to revise these Terms and Conditions at any time by updating these Terms and Conditions of Use. Your continued use of the Site constitutes your agreement to comply with such revisions, so please visit this page from time to time.

 

1. Nonexclusive License

We grant you a nonexclusive, nontransferable, limited right to access the Site, if you comply fully with these Terms and Conditions of Use. You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of Groove Fitness LLC, Grooving with Gigi, without our express prior written consent. You may not use any meta tags or any other "hidden text" utilizing Groove Fitness LLC’s name or trademarks without the express prior written consent of Groove Fitness LLC. Any unauthorized use terminates the rights granted herein by Groove Fitness LLC. You are granted a limited, revocable, and nonexclusive right to create a hyperlink to the home page of the Site so long as the link does not portray Groove Fitness LLC, its affiliates, or their products or services in a false, misleading, derogatory, or otherwise offensive matter. You may not use any Groove Fitness LLC logo or other proprietary graphic or trademark as part of the link without the express prior written permission of Groove Fitness LLC.

 

2. Prohibited Uses

You agree that you will not send, post or otherwise publish through the Site, any message, material, user name or other communication that: (i) is unlawful, offensive, obscene, vulgar, indecent, pornographic, profane, sexually-oriented, threatening, abusive, false or misleading with respect to origin or fact, slanderous, libelous or defamatory; (ii) impersonates any person or entity; (iii) provides personally identifiable information of any person or entity such as an address or phone number; (iv) constitutes or encourages the conduct of a criminal offense; (v) gives rise to liability; (vi) promotes the use of controlled substances; (vii) causes injury of any kind to any person or entity; (viii) infringes or violates the intellectual property rights, contract rights, or any other rights of any third party; (ix) contains harmful or malicious components or code designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; or (x) creates a link to another Site. You agree not to interrupt, or attempt to interrupt, the operation of the Site in any way. You may not advertise or solicit on or through the Site without the express prior written permission of Groove Fitness LLC. You agree that you will not use the Site for chain letter, junk mail, “spamming,” solicitations (commercial or non-commercial) or bulk communications of any kind including, but not limited to, distribution lists to any person who has not given specific permission to be included in such a list.

 

3. Privacy

4. Liability and Release

​

I hereby acknowledge and fully understand the potential dangers incidental to engaging in the dance, fitness and exercise activities offered by Groove Fitness LLC, and that such activities require physical effort and exertion. I further acknowledge and agree that (i) I am responsible for consulting my physician or other health care provider prior to enrolling and participating in a class to determine whether participating in a class is appropriate for me; (ii) I will not enroll in or participate in classes if my physician or health care provider advises against it; and (iii) if I experience faintness, dizziness, pain or shortness of breath at any time during a class that I will stop immediately and contact my physician or health care provider.

 

I acknowledge and understand that my participation in a class could result in my exposure to bodily injury, illness, loss or death, as well as property losses and/or damage to property. For and in consideration of Groove Fitness LLC permitting me to enroll in classes, and the instructor teaching such Classes (the “Instructor”) permitting me to enroll and participate in the classes, and in recognition of the possible dangers to which I voluntarily subject myself by participating in the classes and related activities, I HEREBY AGREE AS FOLLOWS:

 

I hereby voluntarily for myself, my spouse, assignees, heirs, guardians or personal representatives, hold Groove Fitness LLC and the Instructor teaching the classes I enroll and participate in, as well as their agents, employees, officers, directors, spouses, assignees, heirs, guardians or personal representatives blameless and waive any and all rights and causes of action and associated costs for any accident, injury, illness or death, occasioned by my participation in the classes, unless caused by the negligence of Groove Fitness LLC or the Instructor, their agents, employees, officers, directors, spouses, assignees, heirs, guardians or personal representatives.

 

In the event I am injured, I voluntarily agree to assume any financial obligation, either through personal health insurance, or through some other means, for any medical costs which I incur and Groove Fitness LLC and the Instructor teaching the class assumes no responsibility for any medical expenses, injury, or personal damage suffered by me in connection with the use of any facilities or services in connection with the classes, unless caused by the negligence of Groove Fitness LLC or the Instructor, their agents, employees, officers, directors, spouses, assignees, heirs, guardians or personal representatives.

 

I hereby voluntarily assume all risk of damage or loss to my property while participating in the classes and relieve Groove Fitness LLC and the Instructor teaching the class from liability for any and all property damage or loss, unless caused by the negligence of Groove Fitness LLC or the Instructor, their agents, employees, officers, directors, spouses, assignees, heirs, guardians or personal representatives.
